Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Spatial Regal Digital Ltd ("Spatial Regal", "we"), the company behind MoonKart, governing your access to moonkart.online and the MoonKart platform. By creating an account, accessing the Services, or building a storefront, you accept these Terms and our Privacy Policy.

If you use the Services for an organization, you represent that you have authority to bind that organization, and "you" includes it.

2. Your account

• You must provide accurate information and keep it current.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You must be at least 16 years old and legally able to enter this agreement.
• One person or legal entity may not maintain multiple free accounts to circumvent limits.
• Notify us immediately at support@moonkart.online of any unauthorized use.

3. Your stores and content

You retain all rights to the content you create — products, images, pages, copy, and domains. You grant MoonKart a worldwide, non-exclusive licence to host, cache, reproduce, and display that content solely to operate and promote your use of the Services.

You are responsible for what you publish: legality of products, accuracy of claims, licensing of images, tax collection, and compliance with consumer-protection law in every market you sell into.

4. Acceptable use

You must not use MoonKart to sell or promote prohibited items, distribute malware, phish, infringe intellectual property, spam, harass, deceive, or evade sanctions and licensing regimes. Our Acceptable Use Policy forms part of these Terms.

5. AI features (MoonAI)

MoonAI generates drafts of pages, copy, code, and campaigns. AI output is probabilistic: you must review and approve it before publishing, and you are responsible for its accuracy and legality. Do not rely on AI output as legal, financial, or medical advice.

You grant us a licence to process your prompts and workspace context to provide these features. We do not use your private content to train third-party foundation models.

6. Fees, billing, and taxes

• Paid plans are billed in advance; fees are non-refundable except where these Terms or law say otherwise.
• Upgrades take effect immediately with prorated charges; downgrades take effect at the next renewal.
• Late payments may suspend the Services after written notice.
• You are responsible for all applicable sales, VAT, GST, and income taxes arising from your sales; we do not provide tax advice.
• MoonKart charges no mandatory platform transaction fee on your sales — payment-processor fees still apply.

7. Third-party services

The Services interoperate with third parties (payment processors, shipping carriers, app marketplaces, custom domains). Your use of those services is governed by their terms. We are not responsible for third-party services, though we select processors with reasonable care.

8. Suspension and termination

You may cancel at any time from settings; service continues until the end of the paid period. We may suspend or terminate access for material breach, illegal activity, security risk, or non-payment, with notice where circumstances allow. Upon termination we delete your data per our retention schedule — export first.

9. Intellectual property

MoonKart, its logo, interface, software, and templates are owned by Spatial Regal Digital Ltd and protected by copyright, trademark, and trade-secret law. We grant you a limited, non-transferable licence to use them in building your sites. Feedback you send us may be used to improve the product without obligation.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular sales or traffic will be achieved.

11. Limitation of liability

To the maximum extent permitted by law, MoonKart's aggregate liability arising out of these Terms is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.

12. Indemnity

You will defend and indemnify MoonKart against claims arising from your content, your products, your use of the Services, or your breach of these Terms or applicable law.

13. Governing law and disputes

These Terms are governed by the laws applicable at Spatial Regal Digital Ltd's registered place of business, excluding conflict-of-law rules. Parties will first attempt good-faith resolution for 30 days before formal proceedings. Consumers retain mandatory protections of their home jurisdiction.

14. Changes

We may update these Terms; material changes are announced in-product or by email at least 14 days before they take effect. Continued use after that constitutes acceptance. If you reject a change, cancel before it takes effect.
